1.  Preamble

1.1 The University of Queensland Library provides services to support:

  1.1.1 teaching, learning and research activities of students and staff of the University and of associated organisations; and

  1.1.2 the wider community

1.2 These conditions are intended, not to restrict use of library facilities, but to ensure equitable access for all users.

1.3 A fundamental assumption underlying these conditions is that library facilities are a scarce resource so that one user's excessive use disadvantages other users.

1.4 The object of these conditions is to:

  1.4.1 provide an orderly scheme for access to and use of library facilities;

  1.4.2 provide incentives for the prompt return of library material; and

  1.4.3 give staff and students priority over other users;

1.5 These conditions are developed by the University Librarian with the advice of the Library Committee of the Academic Board.

1.6 In these conditions:

  "borrowing limit" means the maximum number of items a permitted borrower may borrow at the same time;

  "deadline" means the time by which a borrower is expected to return library material;

  "expiry date" means a date set for a library user at which the user becomes ineligible to continue to use library facilities as before;

  "ineligible borrower" means a person who has become ineligible to borrow further library material.

  "late material" means library material that a borrower has not returned by the deadline;

  "late sum" is explained in condition 4.2;

  "librarian" refers to the University Librarian, a manager of a branch library or library service, or delegate;

  "library facilities" includes material, buildings, equipment and services;

  "permitted borrower" means a person otherwise eligible to borrow library material who is not an ineligible borrower;

  "prescribed time" means:

  - 1 day following the deadline in the case of reserve/high use material;

  - 5 days following the deadline in the case of 3 and 7 day loan material;

  - 14 days following the deadline in the case of other late material;

  "these conditions" means the Library Conditions of Use.

2.  Conditions of Use

2.1 Subject to these conditions, a librarian controls access to and use of library facilities.

2.2 Conditions and procedures may vary for each category of library user.

2.3 A librarian may issue directions and display notices to implement these conditions.

2.4 For each library user:

  2.4.1 a member of the library staff may set a date as that user's expiry date; and

  2.4.2 a new expiry date may be substituted before the current one is reached; and

  2.4.3 reaching the expiry date makes that user ineligible to use or access library facilities as before.

2.5 A library user's right to use or access library facilities is exclusive of that user.

2.6 A library user must produce proof of identity and of the right to use or access library facilities if required to do so. A person unable to comply:

  2.6.1 must leave the library buildings if asked to do so by a member of the library staff; and

  2.6.2 may be refused further online access.

2.7 The University Librarian, with advice of the Library Committee, may charge a fee for use or access to library facilities, but that staff and students must not be charged for essential use or access.

2.8 The University Librarian may establish a scale of fees in relation to 2.7.

3.  Borrowing

3.1 Subject to these conditions, a permitted borrower may borrow library material.

3.2 Despite these conditions, an ineligible borrower may not borrow library material.

3.3 Conditions may vary for each category of permitted borrower and are published on the library's website and in print.

3.4 For each eligible borrower:

  3.4.1 a member of the library staff must set a date as that borrower's expiry date; and

  3.4.2 a new expiry date may be substituted before the current one is reached; and

  3.4.3 reaching the expiry date makes that borrower an ineligible borrower.

3.5 A librarian may specify library material that is not to be borrowed.

3.6 A librarian may issue directions and display notices to implement borrowing conditions.

3.7 The University Librarian may set the borrowing limit for each permitted borrower or category of permitted borrower.

3.8 A borrower who has reached his or her borrowing limit becomes an ineligible borrower.

3.9 Borrowed material is provided for the exclusive use of the borrower.

3.10 Borrowed material is returned only when the loan has been discharged by an authorised library staff member.

3.11 A borrower must return library material by the deadline which may be specified at the time of issue or renewal or by a written demand for the return of specified material.

3.12 If the deadline falls on a Saturday, Sunday or public holiday, the borrower is not excused from returning the material by then.

4.  Late Material

4.1 A borrower who has not returned library material by the deadline becomes an ineligible borrower.

4.2 The library will record the degree to which material is late using, as a tracking device, a "late sum" in respect of each borrower's late material according to a scale determined by the University Librarian.

4.3 When a late sum reaches $20, the borrower becomes an ineligible borrower.

4.4 If all late material has been returned at the end of a semester, a late sum of less than $20 is cancelled.

5.  Prescribed Time

5.1 A librarian may send a written demand to an ineligible borrower who has not returned library material within the prescribed time.

5.2 The demand must specify:

  5.2.1 each item of library material not returned within its prescribed time;

  5.2.2 the replacement and administrative costs a librarian reasonably determines to be required to replace each item;

  5.2.3 the administrative charge set in the Fee Rules applicable to each item; and

  5.2.4 the total amount demanded (the "amount demanded").

5.3 A borrower who has been sent a written demand must pay to the University the amount demanded.

5.4 The University Librarian may remit all or part of the amount demanded.

5.5 The written demand may be made by sending it to the person's residential address or email address shown on the University's records.

6.  Reinstating Ineligible borrowers

6.1 An ineligible borrower is to be reinstated as a permitted borrower:

  6.1.1 if ineligible under condition 3.4.3, when a fresh expiry date is set; and

  6.1.2 if an ineligible borrower under condition 3.8, when sufficient items are returned; and

  6.1.3 if an ineligible borrower under condition 4.1, when all late material is returned; and

  6.1.4 if an ineligible borrower under condition 4.3, when the relevant administrative charge set in the Fee Rules is paid.

6.2 Despite condition 6.1.3, an ineligible borrower who has been sent a demand under condition 5.1 is to be reinstated as a permitted borrower only if:

  6.2.1 the administrative charge is paid; and either

  6.2.2 all late material is returned; or

  6.2.3 the unremitted part of the amount demanded is paid and any other late material returned.
