Judicial Consideration of Legislation

Checking for judicial consideration of a piece of legislation involves searching for and finding cases in which a section of an Act has been referred to, considered, or discussed.

You can see if a piece of legislation has been judicially considered by the courts by doing a search in a case citator. Both Casebase and FirstPoint provide search boxes especially for this purpose.

  • In CaseBase search in the fields "Act/Regulation" and "Provision".
  • In FirstPoint search in the fields "Legislation Cited (Title)" and "Legislation Cited (Provision)"
  • Provision means the section number of the legislation.
